ProxToMe, Inc. ("ProxToMe" or "us") protects the privacy of all of its customers, visitors, users, and others (collectively "Users" or individually a "User") who visit www.ProxToMe.com (the "ProxToMe Website") or use its mobile application (the “ProxToMe Mobile App”, together with the ProxToMe Website, the “ProxToMe Platforms”).
ProxToMe employs reasonable security measures consistent with standard industry practice for information collected through the ProxToMe Platforms. We believe, but make no representation or warranty, that we have adequate security measures in place in our physical facilities to protect against the loss, misuse, or alteration of the information we collect on our website. We also use internal protections to limit access to Users’ personal information to only those employees who need the information to perform a specific job.
This Privacy Policy details important information regarding the use and disclosure of User information collected on the ProxToMe Platforms. ProxToMe provides this Privacy Policy to help you make an informed decision about whether to use or continue using the ProxToMe Platforms.
This Privacy Policy is incorporated into and is subject to the ProxToMe Terms of Use. Your use of the ProxToMe Platforms and any personal information you provide on the ProxToMe Platforms remains subject to the terms of this Privacy Policy and our Terms of Use.
Please note that any video, image, or other content posted at the direction of Users onto the ProxToMe Platforms becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

How ProxToMe Collects Information

User Provided Information: You provide certain personally identifiable information (which shall include all information on your Facebook account, such as your name and e-mail address) to ProxToMe when choosing to participate in various activities on the ProxToMe Platforms such as transmitting content, updating User profiles or subscribing to newsletters or other mailing lists (including submission of your Facebook account login with access to your basic information, e-mail, profile information, and posting on your behalf to your Facebook account).
Geo-Location Information: Some computers (including a desktop, laptop, mobile phone, tablet, or other consumer electronic device) allow applications to access real-time location-based information (for example, GPS). If permitted by a User to collect such information, ProxToMe Mobile App will collect such information from your mobile device at any time while you download or use the ProxToMe Mobile App. Some photos and videos you share via the ProxToMe Mobile App may also contain recorded location information. If you do not want to store location data in your photos or videos, please consult the documentation for your camera to turn off that feature. Also, an Internet Protocol (“IP”) address can sometimes be used to approximate the location of a particular device.
Cookies Information: When you visit the ProxToMe Platforms, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. ProxToMe uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the ProxToMe Website. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the ProxToMe Platforms may not function properly if the ability to accept cookies is disabled.
Log File Information: When you use the ProxToMe Platforms, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, one or more cookies that may uniquely identify your browser, device name, device address, device OS, device OS version, and device model.
Clear GIFs Information: When you use the ProxToMe Platforms, we may employ “clear GIFs” (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our Users to track which emails are opened by recipients.

How ProxToMe Uses Information

If you submit personally identifiable information (which shall include all information on your Facebook account, such as your name and e-mail address) to us through the ProxToMe Platforms, we will use your personal information to operate, maintain, and provide to you the features and functionality of the ProxToMe Platforms.
Any personal information or content that you voluntarily disclose via the information on your Facebook account that is synced to ProxToMe and displayed on your User profile, as well as any profile picture uploaded to ProxToMe, becomes publicly available and can be collected and used by others. Your account name will be displayed to other Users when you send messages through the ProxToMe Platforms and any User can contact you through the ProxToMe Platforms if you are nearby (generally within 80 meters) or off-range (for sharing with Users saved as a “Favorite”).
We may use your email address or other personally identifiable information to send commercial or marketing messages without your consent, but we will not share your email address or other personally identifiable information with our partners and other third parties without your consent. We may, however, use your email address or other personally identifiable information without your further consent for non-marketing or administrative purposes (such as notifying you of major ProxToMe Platforms changes or for customer service purposes).
ProxToMe has a general policy of not disclosing your personal information to third parties unless you have consented to such sharing. However, we may share the personal information about you that you provide to us with trusted companies we have hired or partnered with to provide services for us, such as sending out our newsletters, fulfilling orders you submit, collecting and processing information or payments on our behalf, or other actions otherwise necessary to provide the ProxToMe Platforms to you. These companies are contractually bound to use personal information that we share with them only to perform the services we have hired or partnered with them to provide. Among the companies whose services we employ may be companies that help us deliver online advertisements such as banner ads. These companies may collect and use information you provide to us to better understand the offers, promotions, and types of advertising that are most appealing to our customers.
We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the ProxToMe Platforms and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.
We may also collect and group demographic and preferences information, responses to surveys and other personal or non-personal information that we collect from you into an aggregate, non-personally identifiable form for disclosure to our existing or potential business partners, affiliates, sponsors or other third parties. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the ProxToMe Platforms.
From time to time, we may collect general, non-personal, statistical information and data analytics based on your or a third-party’s use of the ProxToMe Platforms, such as how frequently someone uses the ProxToMe Platforms, how many and what kinds of clicks occur on hypertexts you may send out in your messages. We collect this information through the use of “cookies” and other tracking technologies, which are discussed in greater detail above in the section on cookies. We collect this information in order to determine which areas of the ProxToMe Platforms are most popular and to enhance the ProxToMe Platforms. As with other aggregated data, we may disclose such data to our existing or potential business partners, affiliates, sponsors or other third parties, but this aggregate data will in no way personally identify you or any other visitors to the ProxToMe Platforms.
We use cookies, clear GIFs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the ProxToMe Platforms; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track any of your entries, submissions, and status in any promotions, sweepstakes, and contests, as applicable.

When ProxToMe Discloses Information

We may provide personally identifiable information and non-personally-identifiable information to businesses or persons for the purpose of processing such information on our behalf. In those instances, we will require that these parties agree to process such information in compliance with our privacy policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.
We do not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.
We do share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the ProxToMe Platforms.
We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. copyright law) or respond to a court order, subpoena, or search warrant.
ProxToMe also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that ProxToMe believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the ProxToMe Platforms, and to protect the rights, property, or personal safety of ProxToMe, our Users or others.

Your Choices About Privacy

You may, of course, decline to submit your Facebook account information (including access to your Facebook profile) or other personally identifiable information through the ProxToMe Platforms, in which case ProxToMe may not be able to provide certain services to you.
To protect your privacy and security, we take reasonable steps to verify your identity for certain services and uses in on the ProxToMe Platforms. You are responsible for maintaining the secrecy of your account information and securing the mobile device with which you use to access the ProxToMe Platforms at all times.

Our Commitment To Data Security

ProxToMe uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit using ProxToMe and you do so at your own risk. Once we receive your transmission of information, ProxToMe makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If ProxToMe learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. ProxToMe may post a notice on the ProxToMe Platforms if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. Our Commitment To Children Privacy

Protecting the privacy of young children is especially important. For that reason, ProxToMe does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the ProxToMe Platforms from persons under 13 years of age, and no part of our services is directed to persons under 13. If you are under 13 years of age, then please do not use or access the ProxToMe Platforms at any time or in any manner. If ProxToMe learns that personally identifiable information of persons under 13 years of age has been collected on the ProxToMe Platforms without verified parental consent, then ProxToMe will take the appropriate steps to delete this information.

California Resident Privacy Rights

From time to time, ProxToMe may share your personal information to third parties who are not affiliated to ProxToMe for marketing purpose. Special Note to International Users

If you are a User accessing the ProxToMe Platforms from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the ProxToMe Platforms, which is governed by U.S. law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.

In the Event of Merger, Sale, or Bankruptcy

In the event that ProxToMe is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

This Privacy Policy may be revised periodically and this will be reflected by the “effective date” below. Please revisit this page to stay aware of any changes.
